The US federal government has filed an appeal against a district court ruling in a multi-state lawsuit over wind energy policy. The notice was submitted on 17 February 2026. The case, State of New York, et al. v. Donald J. Trump, et al. (Civil Action No. 1:25-cv-11221-PBS), was originally decided on 18 December 2025 in the District of Massachusetts.
The federal government, represented by officials led by President Donald J. Trump, is taking the case to the United States Court of Appeals for the First Circuit. The appeal covers the December 18 ruling as well as related court decisions, including orders from 8 December 2025 and 3 July 2025. The filing was made by Michael K. Robertson, a trial attorney with the U.S. Department of Justice’s Environment and Natural Resources Division, under the authority of Adam R. F. Gustafson, Principal Deputy Assistant Attorney General. The plaintiffs in the case are a group of states led by New York. The notice itself doesn’t include the legal arguments, as it simply launches the appellate process.
